This Privacy Policy does not apply to our authorized retailers, or third parties to whom you directly provide your information including but not limited to, subscription services, insurance companies, or other third parties. These entities are independent of us and responsible for their own collection of information. Please refer directly to those entities and their privacy policies for more information.
I.- PERSONAL DATA WE COLLECT AND WHY
“Personal data” refers to any data or information from which an individual may be directly or indirectly identified (“Personal Data”). When we provide our website, products or services, we have a need to process Personal Data. When you:
i. Access and Use our Website: We collect your following Personal Data to provide our website to you:

iii. Schedule a Test Drive: We collect your location information, including your zip code, to schedule a test drive to the local dealer. We also collect your name, e-mail address or phone number, as well as your selected vehicle type, your contact preference type) you choose to include in the webform in order to submit your request to schedule a test drive to the selected dealer.
iv. Confirm your configuration: We collect your name, phone number or email address, country, your contact preference type and zip code after you submit your configuration in order to communicate with you, and provide products or services to you.
v. Subscribe to our Newsletters: We may collect your e-mail address so we can provide you with a service and let you know about our products, events and services. If you no longer want to receive promotional-related emails, you may opt out of receiving them by following the unsubscribe instructions provided in the email you receive. Please note that we may still send you safety messages or product service issues even if you opt out of receiving marketing messages.
We may rely on various legal grounds to collect, use, and otherwise process your Personal Data, including: your consent; that the Personal Data is necessary for providing our website to you; to comply with a legal obligation; to protect your, or someone else’s vital interests; or for a legitimate interest that is balanced against your rights and interests. We share the Personal Data above within the BYD Group family of companies, which includes parents, corporate affiliates, subsidiaries, business units and other companies that share common ownership.
We may also use or share your Personal Data in a de-identified or aggregate manner.
III.- REQUEST FOR ACCESS, RECTIFICATION, CANCELLATION OR OPPOSITION OF PERSONAL DATA (RIGHTS) AND REVOCATION OF CONSENT.
All your Personal Data is treated in accordance with the applicable and current legislation in the Mexico, for this reason we inform you that you have at all times the right to Access, Rectify, Cancel or Oppose the treatment that we give to your personal data, as well as Revoke the consent granted for the treatment of the same; rights that you can assert by sending an email to service.mexico@byd.com, or by calling us at 55 5203 7238., to be provided with the Rights Request form, which must be submitted at the address of the Responsible , and must attach a copy of your official identification to prove ownership. The response to your request for Rights will be sent to the email you have provided, within a term of 20 (twenty) business days from the receipt of said request. Likewise, you are informed that the right of access will be considered fulfilled when the corresponding response is sent through the email that you have indicated to us for this purpose.
IV.- RETENTION PERIOD
We will not use and store Personal Data longer than necessary to fulfil the above mentioned purposes and shall remove the collected Personal Data after the necessary period to achieve the purposes described in this Privacy Policy has passed or required by Applicable Data Protection Law.

Consent Manager:
We have integrated the consent management tool "consentmanager" (www.consentmanager.net) from consentmanager AB (Håltgelvågen 1b, 72348 Västerås, Sweden, mail@consentmanager.net) on our website to obtain consent for data processing and use of cookies or comparable functions. With the help of "consentmanager" you have the possibility to give your consent for certain functionalities of our website, e.g. for the purpose of integrating external elements, integrating streaming content, statistical analysis, measurement and personalized advertising. We do not knowingly collect, use, share or sell the Personal Data of children. If we learn that we have collected Personal Data from a child, we will delete that information.
VIII.- INTERNATIONAL TRANSFER
We are a global company, and we operate internationally. Your Personal Data will be transferred to and stored at our data center located in the United States. We comply with Applicable Data Protection Law on the transfer of information between countries to help ensure your Personal Data is protected as described in this Privacy Policy, wherever it may be.
By virtue of the foregoing, you are informed that, in order to comply with the purposes established in subsection (a), section II of this Privacy Policy, your personal data may be transferred and processed inside and outside Mexico by people other than BYD. In this sense and based on the Law and its Regulations, your personal data may be transferred without the need for your consent in an enunciative and non-limiting manner to: (i) To third-party service providers, solely and exclusively for the fulfilment of the purposes established in subsection (a) of section III of this Privacy Policy (ii) To third parties to carry out extrajudicial and judicial collection procedures in case of non-compliance, (iii) To third party service providers for the investigation and approval, where appropriate, of the corresponding credit for the fulfilment of the purposes established in subsection ( a) of section III of this Privacy Policy; (iv) To the Assembly Plant for the establishment of guarantee conditions, security campaigns (call/recall) and technical updates: (v) To the competent Authorities in matters of vehicle control; (vi) To satellite location system companies for the installation of a location device, recovery and delivery of stolen vehicles; (vii) To financial, banking and credit institutions, for the request to grant credits for the service contracted by the client; (viii) To insurers for the granting of insurance policies for the service contracted by the client.
Transfers with consent:
BYD, may transfer your personal identification data to marketing and advertising companies for the purposes described in subsection (b) section II of this Privacy Policy and to other companies in the automotive distribution sector and goods, products and services with which we have any commercial and/or business relationship with the purpose of granting you benefits when acquiring them. By signing this Privacy Policy, you give us your consent to transfer your personal data. If you do not want your personal data to be transferred to said third parties, you can express your refusal in accordance with the procedure established in this Privacy Policy.
IX.- CHANGES TO THIS PRIVACY POLICY
We reserve the right to amend this Privacy Policy at our discretion and at any time. If the changes allow us to use Personal Data in ways that materially affect your rights, we will post a special note and, if required by law, will prompt you for your consent for certain changes. When we make changes this Privacy Policy, we will post the updated Privacy Policy and update the “Last Updated” date. Each version of this Privacy Policy will be identified by their Last Updated date.
